A Nigerian kidney transplant patient has secured the right to remain in Britain after arguing she would die within weeks if deported to her home country.

Roseline Akhalu, 49, came to Britain to study at Leeds University in 2004 but was diagnosed with kidney failure after her arrival.

She received a successful kidney transplant in 2009 but needs immunosuppressant drugs to keep her alive, along with regular medical checks.

The government refused her permission to stay, but she won an appeal in November. Home secretary Theresa May took further legal action against that ruling, arguing her medical care should be Nigeria's responsibility.

The High Court on Friday upheld the previous tribunal's decision that she should be allowed to stay because of her "exceptional" circumstances.

Akhalu's Leeds community rallied round to campaign for her to be allowed to stay, and Hollywood star Firth added his voice last year, saying: "Our home secretary has effectively condemned an innocent woman to death."

Akhalu, represented in court by Public Interest Lawyers, argued she had no chance of being able to afford the drugs she needs in Nigeria.

Following Friday's judgement, Akhalu said: "Thank you everybody for the support, for the prayers, for the publicity, for everything.

"Hopefully the UK Border Agency will let matters rest at this stage."

The Home Office said it was considering whether to seek permission to appeal the High Court's decision.

THE family of an 18-year-old student convicted of sex attacks on two women have said they cannot believe the "very nice boy" could become a teenage rapist. Omobolanle Akinloye, 18, was given a nine-year sentence at Guildford Crown Court and told he would be deported back to his native Nigeria when he is released. Akinloye was studying business at West London College when he raped a 32-year-old woman in her home in Staines on May 29 last year.

Two months earlier he had groped a 31-year-old woman on a bridge in Kingston Road in the town.

He was convicted of two counts of rape and two counts of sexual assault in December and then sentenced last week.

But speaking from her daughter’s home in Balham, south London, Akinloye’s aunt Ronkea Shittu, 52, said: "He is a very nice boy, he was very quiet and he never got into trouble.

"He is from a very good family, his father is a banker in Nigeria and his mother is a teacher.


"They sent him over here to get an education because people with English qualifications get the best jobs. He is brilliant, very clever, he wanted to be an accountant."

Akinloye was living with his twin cousins in Morten Close, Balham, when both attacks happened.

On the night of May 29 last year, Akinloye was going back home with his cousin when he started talking to a drunk woman at Staines railway station.

He had spotted her iPhone on the floor and handed it back to her.

During his eight-day trial at Guildford Crown Court, the jury heard how Akinloye went back to the woman’s house and raped her twice, once downstairs in the living room and once upstairs in a bedroom.

Akinloye is serving his sentence in a young offenders institution.
